User, listener, receiver, and/or viewer understands and acknowledges that trade secrets, patents, and other intellectual property, collectively hereafter called the "secrets," consist of information and materials that are invaluable to the daily operations of business. These materials are irreplaceable and include but are not limited to production, operational, financial, sales, and marketing information.

User, listener, receiver, and/or viewer hereby agrees to treat any intentional or unintentional disclosure of the secrets with the same degree of care and safeguards that it takes with its own trade secrets, but at no time less than a reasonable degree of care.

User, listener, receiver, and/or viewer hereby agrees to hold the secrets in strictest confidence, make no commercial use of the secrets, make no reproductions or copies of the secrets including this policy in its entirety, and not disclose the secrets to any employee or third party.

This nondisclosure statement does not apply to any information which is independently developed as a work-for-hire.

This agreement remains in force after expiration of any content or advertising and until the secrets are no longer trade secrets and intellectual property expires without options for renewal.

User, listener, receiver, and/or viewer understands and agrees that this nondisclosure policy does not in any form constitute a grant or an intention or commitment to grant any right, title, or interest in the secrets. Furthermore, user, listener, receiver, and/or viewer understands and agrees that viewing, using, receiving, listening or interacting with related websites, databases, networks, telecommunications, and other materials does not in any form constitute a grant or an intention or commitment to grant any right, title, or interest in the secrets.

User, listener, receiver, and/or viewer recognizes and acknowledges that any breach or threatened breach of the secrets may cause irreparable harm for which monetary damages may be inadequate. User, listener, receiver, and/or viewer agrees that owner of the secrets shall be entitled to an injunction to restrain user, listener, receiver, and/or viewer from such breach or threatened breach. Furthermore, nothing in this nondisclosure policy shall be construed as preventing pursuit of any remedy in equity and/or in law for any breach or threatened breach of the secrets.

If legal action does arise relating to this nondisclosure policy and/or the secrets, owner shall be entitled to recover all arbitration and legal costs including but not limited to court costs, attorneys' fees, and expenses.

Modifications to this nondisclosure policy may be made at any time without notice.

No agency, partnership, joint-venture, and/or other relationship is made between the parties through this nondisclosure policy and/or by using, viewing, listening, receiving, and interacting with the secrets.
